| dc.description | La aplicación de las normas penales en materia contravencional de tránsito tiene un componente habitual de remisión a reglamentos técnicos, por lo que puede ser con-troversial su aplicación práctica en correspondencia con los derechos humanos re-conocidos. El presente trabajo tiene como objetivo central analizar el derecho a la seguridad jurídica frente a la aplicación del artículo 389 numeral 7 del Código Or-gánico Integral Penal. A través de un enfoque cualitativo que combina la revisión documental y el método inductivo, fundamentalmente, se estudia cómo se garantiza el derecho a la seguridad jurídica por los operadores jurídicos y agentes de tránsito, en especial porque dicha norma requiere establecer condiciones técnico-mecánicas de los vehículos que muchas veces escapa a la competencia de dichos agentes. En esencia, se concluye que deben establecerse límites legales para la aplicación de la norma penal cuestionada debido a que se configuración actual representa eventuales violaciones al derecho a la seguridad jurídica. | |
| dc.description.abstract | The application of criminal law to traffic violations typically involves referencing technical regulations, which can make its practical application controversial in re-lation to recognized human rights. This paper aims to analyze the right to legal certainty considering the application of Article 389, paragraph 7 of the Comprehen-sive Organic Criminal Code. Through a qualitative approach that combines docu-mentary review and the inductive method, the study examines how the right to legal certainty is guaranteed by legal professionals and traffic officers, especially since this regulation requires establishing technical and mechanical conditions for vehi-cles that often fall outside the competence of these officers. Essentially, the paper concludes that legal limits must be established for the application of the challenged criminal law because its current configuration represents potential violations of the right to legal certainty. | |
