dc.descriptionEl presente trabajo investigativo comprende el análisis de los casos excepcionales contemplados en la Constitución del Ecuador 2008 para el proceso de intervención de competencias dirigidas a los gobiernos autónomos descentralizados; asimismo, incluye la explicación de la formación del Estado, el análisis de un servicio público como competencia, el proceso de intervención contemplado en el Código Orgánico de Organización Territorial, Autonomía y Descentralización, y el análisis de un caso de intervención. El examen exhaustivo del caso de intervención evita que existan ambigüedades en la interpretación de la legislación y determinar los aspectos prácticos efectuados que sirve como precedente para otros procesos de intervención administrativa. Para agilizar el proceso del caso se omitieron fases en la autorización de intervención por la situación de emergencia y es importante resaltar que la escaza aplicación de este proceso limita la comprensión de los casos excepcionales dirigidos a la declaración de un estado de excepción.es
dc.description.abstractThe present investigative work includes the analysis of the exceptional cases contemplated in the 2008 Constitution of Ecuador for the intervention process directed to the Decentralized Autonomous Governments; In addition, it includes the explanation of the formation of the State, the analysis of a public service as competence, the intervention process contemplated in the Código Orgánico de Organización Territorial, Autonomía y Descentralización, and the analysis of an intervention case. The exhaustive examination of the intervention case avoids ambiguities in the interpretation of the legislation and determines the practical aspects carried out which serves as a precedent for other administrative intervention processes. In order to speed up the process of the case, phases were omitted in the authorization of the intervention because of the emergency and it is important to highlight that the limited application of this process limits the understanding of the exceptions cases addressed to the declaration of a state of exception.es
