Sexual violence against children and adolescents constitutes a serious violation of human rights that demands clear and coherent criminal responses. Within the Ec-uadorian legal system, these conducts have traditionally been classified under the term “child pornography,” a designation that is problematic because it implicitly suggests voluntariness or consent, elements that are legally nonexistent in relation to minors. This research examines the adequacy of such classification considering international standards that recognize these acts as Child Sexual Abuse Material. The study adopts a qualitative, doctrinal, and descriptive approach through the normative analysis of the Ecuadorian Comprehensive Organic Criminal Code and the Code on Children and Adolescents, as well as a comparison with international and comparative standards. The findings indicate that the continued use of the term “child pornography” weakens the proper legal recognition of the victim and hinders the harmonization of Ecuadorian criminal law with international child protection frameworks. The paper concludes that terminological reform is neces-sary to strengthen criminal protection and explicitly recognize minors as victims of sexual abuse.
