dc.description.abstract"According to Insight Crime, Ecuador is the most violent country in South America, with a homicide rate of 38 per 100,000 inhabitants. This scenario has revived the old belief in the freedom vs. security paradigm. Populism often leads the masses to believe that excessive guarantees are the genesis of insecurity, which is why solutions in these models tend to involve punitive responses, as well as the reduction, limitation, or annulment of constitutional guarantees. In this sense, a new intelligence law was published in Ecuador. Article 52 of this law states that the highest state security intelligence authority may request the retention, opening, or interception of documents or communications, while the Constitution, in Article 66, numeral 19, establishes that such actions require the consent of the holder. This research seeks to determine whether the aforementioned article of the law violates fundamental rights and human dignity."
