| dc.description.abstract | Mediation and arbitration are gaining prominence in the Ecuadorian legal system as alternatives for resolving conflicts in the public and private sectors, serving as a means to alleviate the judicial burden, particularly in the province of Guayas. Mediation, in particular, is not only an alternative method of conflict resolution but also emphasizes a humanistic approach, promoting peaceful solutions and minimizing the harmful impact between the parties involved. This process has significantly evolved since the 20th century, focusing on the principle of autonomy of will, which has driven its expansion alongside other mechanisms such as conciliation and arbitration. Several authors highlighted in this article underscore the role of mediation in peacebuilding and the prevention of violent conflicts, promoting a collaborative and human-centered approach. In Ecuador, the "culture of peace" has impacted the workload of the courts, especially in Guayas, where it is being investigated whether the inclusion of mediation in the law has helped to reduce judicial time and costs. The aim of this article is to promote mediation through verifiable data, emphasizing its impact on the efficiency of the judicial system. | |
