| dc.description | El presente trabajo de investigación se basa en si se están cumpliendo con los principios de igualdad, tutela judicial efectiva, seguridad jurídica y presunción de inocencia cuando una sentencia condenatoria se basa exclusivamente en el testimonio de la víctima/testigo y el acusado niega rotundamente haber cometido el crimen del que se lo acusa. Esto sucede cuando se dice que el hecho punible sí sucedió y por ende se da por probado con tan sólo la palabra de quien se presenta en calidad de víctima, en relación a un hecho delictivo cometido tiempo atrás y del que no queda rastro alguno que ocurrió. Así también, mediante esta investigación demostraremos como los escasos análisis psicológicos utilizados en los casos de violación sexual en el Ecuador no suplen la falta de fundamentación de una sentencia que se basa en la sola afirmación de la palabra de la víctima/testigo. | es |
| dc.description.abstract | This paper is based on whether the principles of equality, effective judicial protection, legal certainty and presumption of innocence are being fulfilled when a conviction is based exclusively on the testimony of the victim / witness and the defendant flatly denies having committed the crime of which he is accused. This happens when it is said that the punishable act did happen and therefore it is taken for granted with the only word of the one who presents herself as a victim, in relation to a criminal act committed long ago and of which there is no trace left that occurred. Likewise, through this investigation we will demonstrate how the scarce psychological analyzes used in the cases of rape in Ecuador do not replace the lack of foundation of a sentence that is based on the sole affirmation of the word of the victim / witness. | es |
