In our country, since the enactment of the Organic Code for Children and Adolescents, obligations have been established to respect the principle of the best interests of the child. This legal framework stipulates in Article 16 the obligation to pay additional child support payments (thirteenth-month bonuses) without exception. However, there are individuals who do not have formal employment that would allow them to receive this legal benefit. This provision has led to legal disputes regarding payment. This paper analyzes the legal nature of these bonuses as employment benefits and their correlation with family law. It examines current regulations and the actual economic capacity of those obligated to pay without formal employment. The aim is to demonstrate the unconstitutionality of the law through a debate that questions the inequality and disproportionality of the obligation to pay additional child support. It is proposed that those who do not receive additional child support payments should pay a proportional amount according to their income.
