The purpose of this paper is to determine if the Constitutional Court, established by the 2008 Constitution, has fulfilled its fundamental mission of protecting the supremacy of the Constitution and the basic principles of the rule of law. Or maybe, on the contrary, there is sufficient evidence and arguments to affirm that, given the broad powers conferred upon it and the notable ideological influence of the majority of its members and former members, it is configured as an entity that, under the guise of protecting the Constitution and human rights, arbitrarily intervenes in all branches of government, in any matter, claiming to hold the hermeneutical key to the so-called "evolution of the times." Its decisions are always beyond appeal and subject to immediate enforcement. A documentary legal research methodology will be used, in addition to supporting many of its assertions in treatises by some of the leading figures of Ecuadorian and international constitutionalism, along with classic works of political philosophy.
