Abstract

The legitimate use of force constitutes an exclusive power of the State, which is in charge of protecting the legal assets of the people who are within the territorial circumscription and whose purpose is to enforce the law ensuring state sovereignty and citizen security, and whose actions must be complied with principles and guarantees standardized by the different international organizations. Therefore, those international organizations must contemplate that this action of executing force in a legitimate manner complies with the parameters of legality, proportionality and absolute necessity. Consequently, it is necessary to carry out an exhaustive analysis of these principles and the excesses that occur in certain judicial processes coerced against members of the National Police, who despite having this exclusive power, tend to have reprisals against them. That is to say, it is necessary to carry out an interpretative analysis of the scope and legal consequences suffered by members of the National Police.
