Vicarious gender violence, defined as that action that is carried out against children or people in the emotional environment, to cause psychological, physical or moral harm to a woman, has become a growing phenomenon among the Ecuadorian population. Despite its severity, this type of violence is not classified within the Comprehensive Organic Penal Code (COIP), allowing aggressors to go unpunished and victims to remain unprotected, evidencing legal loopholes that perpetuate impunity and deepen the effects on women and their family environment. This article analyzes the urgency of classifying this form of violence in the COIP, taking as reference a media case in Ecuador, in which the ex-wife of a political figure has publicly denounced the use of her daughter as an instrument of emotional damage and control. Based on a dogmatic, sociological and legal approach, a law reform is proposed that recognizes vicarious violence as an autonomous crime, guaranteeing mechanisms to prevent, punish and comprehensively compensate the victims.
