This research addresses the challenge posed to contemporary criminal law by the emergence of artificial intelligence, particularly regarding the potential commission of crimes through automated systems. The central legal problem lies in determining who should be held criminally liable when an algorithm, acting with operational autonomy, causes harm to protected legal interests, questioning the validity of traditional dogmatic categories. Through a dogmatic-legal methodological approach, the principles of guilt, personal liability, and the prohibition of strict liability within the Ecuadorian legal system are analyzed. The findings demonstrate that, given the absence of consciousness and will in the machine, it is legally impossible to attribute criminal guilt to it. Instead, imputation mechanisms directed at the human being who holds control or the guarantor position, such as indirect perpetration and commission by omission, are utilized. It is concluded that the legitimacy of the punitive system requires maintaining criminal judgment as a strictly human act, rejecting the creation of artificial subjects and sanctioning, instead, the negligent or malicious management of technological risk by natural or legal persons
