LA ANTINOMIA EN LA REGULACIÓN DEL DERECHO HEREDITARIO DE NIÑOS ADOPTADOS EN EL ECUADOR

Abstract

The Constitution enshrines the principle of equality of filiation, under which all children, regardless of whether they are of biological or adoptive origin, are entitled to the same rights and obligations without any form of discrimination. However, an analysis of the provisions of the Civil Code reveals that certain rules, historically grounded in the concept of consanguinity, give rise to a legal conflict (normative antinomy) with the Code on Children and Adolescents -CONA-, thereby creating legal uncertainty and practical barriers in the application of intestate succession proceedings involving adopted children. Against this background, the present study aims to examine the normative antinomy between the Civil Code and the Code on Children and Adolescents -CONA- concerning the inheritance rights of adopted children in Ecuador, with the purpose of proposing harmonized interpretative criteria that ensure compliance with the principle of the best interests of the child and the equality of filiation. The research adopts a qualitative doctrinal approach, applying analytical and synthetic methods to the documentary examination of civil legislation, family law doctrine, and the applicable constitutional framework. The findings indicate that the rigidity of the traditional consanguinity-based succession model must yield to constitutional mandates, leading to the conclusion that unified judicial and notarial interpretative guidelines are required to guarantee the full inheritance rights of adopted children on an equal footing with biological children
