Abstract
This research paper aims to demonstrate the existence of a legal vacuum in the
Ecuadorian legal system regarding the sanction of sexual harassment against children
and adolescents through the use of artificial intelligence. The analysis is approached
from a historical and legal perspective in order to highlight the seriousness and scope
of the problem under investigation.
The main hypothesis is that audiovisual content generated by artificial intelligence must
be regulated to ensure its proper use. Given the wide accessibility of these tools to
anyone with an electronic device, it is alarming how easily sexually explicit material
involving minors can be created. These technologies are designed to follow user
instructions without evaluating the legality or purpose of the content being generated,
posing serious risks to the rights of children and adolescents in digital environments.

El presente trabajo investigativo tiene como objetivo primordial demostrar la
existencia de un vacío legal en el ordenamiento jurídico ecuatoriano respecto a la
sanción del acoso sexual a niños, niñas y adolescentes con el uso de la inteligencia
artificial. Abordo mi punto de vista desde un ámbito histórico y jurídico para poder
visualizar la gravedad y el alcance de la problemática de la presente investigación. La
hipótesis principal se basa en que el contenido audiovisual generado por inteligencia
artificial debe de tener regulaciones las cuales permitan un adecuado uso de aquellas ya
que a estas de ser de gran accesibilidad para todo aquel que posea un dispositivo
electrónico, es alarmante la cantidad de contenido de índole sexual que involucra a
menores y que puede ser generado por mencionada inteligencia las cuales están
diseñadas para directamente hacer lo que su usuario le solicite sin medir a cuentas si es
legal o a su vez para con qué fines se realizan este mismo contenido audiovisual.
