The Constitutional Court, as the highest authority for the oversight, interpretation, and administration of justice in constitutional matters, constitutes the appropriate and technically competent institutional model for safeguarding the rule of law under any circumstance. Its essential function is to prevent political interests or interference from intruding into decisions of a constitutional nature. Within a reflective theoretical framework, Hans Kelsen (1934), in his Pure Theory of Law, proposes that law be studied independently from politics or morality, grounded in a strictly epistemological and methodological foundation. Under this approach, legal analysis must not consider who holds power, but rather the formal validity of acts within the prevailing legal order. The methodology applied is the dogmatic or doctrinal method, focused on the judgment issued in Case No. 372-23-EP/24 concerning the appointment of the Superintendent of Banks. From an academic standpoint, the analysis highlights the concepts of vested legal situation, legitimate expectation, and immutability, in response to a ruling that reveals questionable conduct by the Constitutional Court. Accordingly, the central legal issue arises: Does Judgment 372-23-EP/24 constitute a decision tainted by political considerations that compromise the purity of law and constitutional standards?
