| dc.description.abstract | This paper analyzes the background of the security crisis in Ecuador that motivated Executive Decree No. 111 of 2024. Through a qualitative dogmatic-legal approach, jurisprudential analysis, and comparative law (Mexico and Colombia), it examines the distortion of the military role and the evasion of the statutory reserve by delegating public order to the Armed Forces. As consequences of this militarization, serious transgressions of Article 158 of the Constitution, operational opacity, and the violation of fundamental rights—including transient enforced disappearances—are identified due to the application of combat tactics in civil settings, contravening Inter-American Court of Human Rights standards. As essential results, the study concludes that the decree incurs formal and material unconstitutionality by consolidating a permanent regime that evades civil control and erodes the block of constitutionality. In response, it proposes the design of a digital Concurrent Registration Protocol, under the exclusive jurisdiction of ordinary justice and oversight by the Ombudsman's Office, to guarantee accountability and prevent impunity. | |
