In Ecuador, although this form of violence is recognized in the Organic Law to Prevent and Eradicate Violence against Women, gaps persist in its articulation with the criminal system, hindering the investigation and punishment of conducts that, due to their severity, escalate into serious affectations of sexual and repro-ductive integrity. This paper analyzes the issue from a constitutional and gender perspective through a qualitative approach and analytical-descriptive method, identifying the violation of fundamental rights such as human dignity, personal in-tegrity, and health. Furthermore, state responsibility regarding these practices is examined in light of the Constitution and international standards, with special em-phasis on the Brítez Arce and others v. Argentina case. Finally, through the com-parative method with the Argentine legal system, the research proposes as a result legal guidelines and a reform to the Organic Integral Criminal Code to strengthen the constitutional and criminal protection of women, ensuring an effective state response to obstetric violence in Ecuador
