| dc.description.abstract | This paper analyzes the application of the principle of proportionality in the setting of additional alimony payments within current Ecuadorian legislation. It is based on the recognition of child support as a fundamental mechanism to guarantee the integral development of children and adolescents; however, it also warns that its practical application may generate imbalances when the real economic conditions of the obligated party are not adequately assessed. The study examines the current legal framework, with special attention to unnumbered Article 16 of the Organic Code of Children and Adolescents, in order to identify how additional child support payments are established and whether they respond to criteria of reasonableness, necessity, and material balance. The research argues that the main problem arises when these obligations are imposed automatically, without verifying whether the extraordinary income received by the payer, specifically the fourteenth month salary, is truly connected to the amount of the additional alimony set by the court, this can result in a disproportionate financial liability relative to the individual’s actual ability to pay. In this regard, the study seeks to provide legal criteria that contribute to the legal certainty of children and adolescents, as well as to the protection of the rights of the obligated child support debtor. | |
