ESTUDIO DE LA PROPORCIONALIDAD DE LAS MEDIDAS CAUTELARES EN EL PROCEDIMIENTO COACTIVO REGULADO EN EL CÓDIGO ORGÁNICO ADMINISTRATIVO.

| dc.description | El trabajo estudió la imposición de las medidas cautelares en materia coactiva establecida en el Código Orgánico Administrativo, cuya limitación se fija al saldo de la obligación pendiente, encontrando el problema jurídico en cuanto la referida limitación que, en caso de incumplimiento puede entenderse que atenta a la seguridad jurídica y al principio de proporcionalidad, sobre este principio, se estableció los parámetros que determinan su efectiva aplicación. Para lo cual, se utilizó los métodos de investigación cualitativo y deductivo; adicionalmente, se utilizó dos metodologías específicas, la axiológica y la realista para el análisis de los conceptos y principios jurídicos. Los resultados muestran que la aplicación del principio de proporcionalidad para la adopción de las medidas cautelares en un procedimiento de ejecución coactiva, debe de obedecer a un ejercicio racional de la motivación del acto, asegurando que la medida adoptada es adecuada y necesaria en relación con el cumplimiento de un fin legítimo, donde se debe ponderar el interés colectivo representando en el Estado. Se concluyó que en efecto esta normativa, la limitación que establece hace complejo que sea aplicable a la naturaleza del tipo de medida cautelar a emplear, y puede ser solventada con un test de proporcionalidad, a fin que justifique el acto y asegure el cumplimiento de la obligación; adicionalmente, se aprecia que el mismo artículo no establece la posibilidad de que las medidas cautelares puedan ser dictadas previo a la emisión de la orden de cobro, con un procedimiento previo como lo establece la norma procesal ordinaria. | |
| dc.description.abstract | This work studied the imposition of precautionary measures in coercive matters established in the Organic Administrative Code, whose limitation is set to the balance of the pending obligation, finding the legal problem regarding the aforementioned limitation that, in case of non-compliance, can be understood to threaten legal certainty and the principle of proportionality, on this principle, the parameters that determine its effective application were established. For which, qualitative and deductive research methods were used; additionally, two specific methodologies were used, axiological and realistic, for the analysis of legal concepts and principles. The results show that the application of the principle of proportionality for the adoption of precautionary measures in a coercive execution procedure must obey a rational exercise of the motivation for the act, ensuring that the measure adopted is appropriate and necessary in relation to the fulfillment of a legitimate purpose, where the collective interest represented in the State must be weighed. It was concluded that in effect this regulation, the limitation it establishes makes it complex to be applicable to the nature of the type of precautionary measure to be used, and can be solved with a proportionality test, in order to justify the act and ensure compliance with the obligation; Additionally, it can be seen that the same article does not establish the possibility that precautionary measures can be issued prior to the issuance of the collection order, with a prior procedure as established by the ordinary procedural standard. | |
