Abstract
For this paper, power deviation was analyzed as a legal institution that establishes parameters
and limits for the administrative actions carried out by public officials in the exercise of their
duties, safeguarding the public interest, based on its clarification in the Ecuadorian Organic
Administrative Code. The inductive logical method and the documentary analysis technique
served as tools to conclude that the inclusion of power deviation in the legal system is essential
for the protection of the public interest.

Para el presente trabajo, se analizó a la desviación de poder como una institución jurídica que
permite establecer parámetros y límites a las actuaciones administrativas que realizan los
funcionarios públicos en el ejercicio de sus funciones, salvaguardando el interés público, a partir
de su esclarecimiento en el Código Orgánico Administrativo Ecuatoriano. El método lógico
inductivo y la técnica del análisis documental, sirvieron de herramientas para llegar a la
conclusión de que la inclusión de la desviación de poder en el ordenamiento jurídico es esencial
para la protección del interés público.
