| dc.description | El siguiente trabajo de titulación consiste en analizar las Opiniones Consultivas de la Corte Interamericana de Derechos Humanos y si estas pueden modificar la constitución ecuatoriana. El estudio se lo realiza a través de conocer su naturaleza, considerando lo que dicta La Convención Americana de Derechos Humanos, reglamentos y otras fuentes relacionadas con el tema, comparándola con la doctrina que existe, para de esta forma poder llegar a una comprender sobre la importancia que tienen dentro del Sistema Interamericano de Derechos Humanos, todo lo que conlleva esta función, y la forma en la que se tiene que aplicar al realizarse. Además, se realizan observaciones sobre el bloque de constitucionalidad para desarrollar el rol que tiene todo el contenido que se desplegué de los Tratados Internacionales de Derechos Humanos dentro del ordenamiento jurídico ecuatoriano. Por último, se examina la Sentencia No. 1 1-18-CN/19, para concebir de qué forma las Opinión Consultiva puede influir dentro de la Norma Suprema. | es |
| dc.description.abstract | The next degree work consists of analyzing the Advisory Opinions of the Inter-American Court of Human Rights and if they can modify the Ecuadorian constitution. The study is carried out through knowing its nature, considering what is dictated by the American Convention on Human Rights, regulations and other sources related to the subject, comparing it with the doctrine that exists, in order to reach an understanding of the importance they have within the Inter-American Human Rights System, everything that this function entails, and the way in which it has to be applied when it is carried out. In addition, observations are made on the constitutionality block to develop the role of all the content that was deployed from the International Human Rights Treaties within the Ecuadorian legal system. Finally, Sentence No. 1 1-18-CN / 19 is examined to conceive of how the Advisory Opinion may influence within the Supreme Norm. | es |
