This paper examines the regulatory tension between the constitutional rights of nature, enshrined in Articles 71 through 74 of the 2008 Constitution of the Republic of Ecuador, and the constitutional reform initiatives promoted during 2025 with the purpose of relaxing said protections in favor of large-scale extractive activities, particularly mining and hydrocarbon exploitation. The author analyzes the content and limits of the rights of Pachamama in light of the jurisprudence of the Constitutional Court of Ecuador, with particular reference to landmark cases such as those known as Chibunga and Galápagos. The potential impact of the November 2025 popular referendum on the environmental normative hierarchy and the international commitments derived from the Escazú Agreement is likewise assessed. Finally, alternative legal mechanisms are proposed to reconcile the imperative of economic development with the effective protection of the environment, including reforms to the Organic Environmental Code and the implementation of strengthened prior consultation protocols. The research concludes that regression in constitutional environmental protection is legally unviable without violating the principles of progressiveness and non-regression. 5
