This paper analyzes how trial judges in Ecuador apply constitutional precedent regarding the denaturalization of the constitutional protection action and the principle of subsidiarity. According to the jurisprudence of the Constitutional Court, particularly judgments No. 2231-22-JP/21 and No. 1158-17-EP/21, the mere existence of an ordinary judicial remedy is not sufficient to declare the inadmissibility of a constitutional protection action. Judges must first evaluate the suitability and effectiveness of such remedy to protect the allegedly violated constitutional right. However, judicial practice shows a tendency to apply these criteria restrictively, using the concept of “denaturalization of the action of protection” as an automatic formula to dismiss constitutional claims without conducting a substantive analysis of the alleged rights violation. The research adopts a qualitative approach and a dogmatic-legal methodology based on the analysis of constitutional provisions, legal norms and constitutional precedents. The study concludes that this incomplete application of constitutional precedent may limit access to constitutional justice and undermine the right to effective judicial protection.
