This degree thesis broadly addresses the concept of Comprehensive Reparation and its components, with special emphasis on moral damage and its compensation within the administrative litigation sphere. It examines how the determination of the compensation amount is entrusted to judicial discretion, as established in Article 2232 of the Civil Code. Moral damage is inherently immeasurable, and the absence of regulations guiding its assessment leads to a lack of uniformity in judicial decisions, generating inequality and legal uncertainty—even in cases with analogous circumstances. This legal issue motivates the proposal of an alternative to fill that regulatory gap. The methodology applied was qualitative and dogmatic research, involving a review of legal doctrine and juridical analysis. This allowed the identification of current limitations in assessing immaterial damage, especially the lack of objective parameters, which results in disparities among rulings. As a result, a concrete, legally viable, and justice-aligned guiding alternative is proposed. This contribution seeks to provide the justice system with an objective, auditable, and replicable calculation tool to achieve more equitable and predictable compensation.
