Abstract

This research analyzes the normative tension between confidentiality in tax mediation and the inalienable right of workers to receive their 15% profit-sharing in Ecuador. Background analysis shows that audits by the Internal Revenue Service recalculate the Income Tax base; however, the absolute secrecy protecting settlement agreements prevents the labor authority from learning about these adjustments. Applying a qualitative methodology with a dogmatic-analytical approach and documentary review, this study examines the lack of inter-institutional connection between fiscal and labor spheres. Consequently, the confidentiality of mediation prevails over transparency and social justice, hindering the timely recalculation of workforce benefits. As a result, a reform to Article 50 of the Arbitration and Mediation Law is proposed to create a specific exception toward the Ministry of Labor, alongside updating ministerial regulations and adjusting Judiciary Council reporting formats. This inter-institutional coordination model guarantees respect for labor rights efficiently and without additional administrative costs.
