Abstract
Considering that pregnant women have the right to alimony from the moment of conception until twelve months after birth or the eventual death of the fetus, it is important to evaluate what happens if such alimony is claimed against a person other than the father of the unborn child. Therefore, this paper seeks to establish the legal consequences of obtaining alimony for pregnant women when they deceive themselves regarding the identity of the alleged father. Through a qualitative approach and a documentary, legislative and jurisprudential review, this problem is analyzed; it also determines the legal framework applicable to the case and the legal and procedural strategies of the defendant in any of the situations that may arise in such a context. In summary, it is concluded that it is not feasible to apply the rules of the Civil Code on restitution and compensation for damages when there is a fraudulent or negligent attitude when claiming prenatal support, so a reform to the Code of Children and Adolescents is necessary to establish a way to act in such cases.
