The objective of this paper was to analyze the ruling 2933-19-EP/24 for violation of constitutional rights. The methodology applied was exploratory with a qualitative approach, taking into consideration the analysis of ruling 2933-19-EP/24 as the primary source of research. As a result, the Constitutional Court of Ecuador resolved to accept the extraordinary protection action 2933-19-EP and declare that the Criminal Chamber of the Provincial Court of Justice of Azuay violated the right to effective judicial protection in a case of sexual violence. In addition, as reparation measures, the dismissal order of September 5, 2019 was annulled and a new conformation of the Criminal Chamber was ordered to reevaluate the plaintiff's appeal. The Judicial Council was instructed to disseminate the ruling and train justice operators on gender perspective and negative stereotypes. The Court stressed the importance of eliminating gender stereotypes in the judicial system to ensure equal access to justice and prevent impunity in cases of sexual violence. In conclusion, these actions seek to strengthen the protection of human rights and ensure impartial and effective justice. Future recommendations include conducting comparative studies with other countries that have implemented similar measures to eradicate gender stereotypes in the judicial system.
