| dc.description | Mediante el presente trabajo de grado determinamos la necesidad y utilidad de la implementación en el Código Orgánico Integral Penal de criterios de selección respecto de la lex artis aplicable en los casos de homicidio culposo por mala práctica médica, y lo hicimos mediante un análisis integral de la doctrina y jurisprudencia que trata la prueba científica, el deber objetivo de cuidado, los tipos penales en blanco, el principio de legalidad y la valoración de la prueba. Con lo cual nos fue posible determinar que debido a la falta de criterios de selección respecto de la lex artis disponible para el caso de estudio, causa que los magistrados ecuatorianos estén impedidos de cumplir los criterios de valoración de la prueba establecidos en el Art. 457 del referido texto normativo. Por tanto, luego de aplicar el enfoque metodológico racionalista y un análisis inductivo a partir de técnicas cualitativas, concluimos que el juez al momento de elegir la lex artis aplicable al caso concreto, debe analizar respecto de las opciones disponibles, su actualidad, especialidad, grado de comprobación y nivel de riesgo, a fin de seleccionar objetivamente la lex artis que más se adapte a las circunstancias fácticas del caso, lo que, además, le permitirá emitir una decisión de una alto nivel científico y objetivo. | |
| dc.description.abstract | Through this degree paper, we stablish the need and usefulness of the implementation, in the Ecuadorian Criminal Code, of selection criteria regarding the lex artis applicable in cases of medical manslaughter.
