| dc.description.abstract | This article examines the application of sana crítica as a system of evidentiary assessment in judicial decisions, with particular emphasis on the arbitrariness that may arise when the weighing of evidence lacks adequate justification. Within the framework of a constitutional State governed by the rule of law, the motivation of judicial decisions constitutes a fundamental guarantee of due process and legal certainty. Using a legal-dogmatic and documentary approach, the study analyzes how judges assess different types of evidence such as testimonies, expert reports, documents, and material evidence and the criteria of logic, experience, and scientific knowledge that should guide this process. The research draws on relevant Ecuadorian doctrine, legislation, and case law in order to identify the boundaries between legitimate judicial discretion and arbitrariness. The findings indicate that arbitrary decisions do not stem from evidentiary discretion itself, but rather from its exercise without clear, rational, and verifiable reasoning. Consequently, the article concludes that an improper application of sana crítica undermines the legitimacy of judicial decisions, affects constitutional guarantees, and weakens public confidence in the administration of justice. | |
