| dc.description.abstract | The present study analyzes the technical inconsistency and regulatory gap found in the third sub paragraph numeral two of Article 386 of the Ecuadorian Organic Comprehensive Criminal Code (COIP). This provision sanctions driving with a license of a different category but omits any reference to the types of driving licenses defined in the Traffic Regulations. This ambiguity has generated legal uncertainty and has allowed drivers who fall within the same category to operate vehicles for which they lack the required authorization and training. Methodologically, the study employs legal dogmatic analysis and the comparative method, contrasting Ecuadorian legislation with the regulatory models of Spain, Peru, and Chile. The results show that the omission of the term “type” in the COIP violates the principle of criminal legality (tipicidad penal) and the maxim of taxativity. Comparative law—particularly the Peruvian model—uses the expression “class or category,” which encompasses both levels of classification and serves as the most suitable reference for reform. The essential solution is to amend Article 386 sub paragraph third numeral two of the COIP to include the term “type” alongside “category.” This modification ensures consistency with the Traffic Law and guarantees the effectiveness of the criminal sanction in favor of road safety. | |
