The absence of a specific regulation on paternal fraud within the Ecuadorian legal system has been identified, particularly regarding its different forms and the resulting legal consequences. This study aims to analyze the violation of the rights to identity and legal certainty in the face of this phenomenon. A qualitative approach was employed, using the inductive–deductive method and the technique of documentary review. The proposed hypothesis was confirmed, and the need to include precise regulations in the Civil Code and the Organic Integral Criminal Code was established, to provide mechanisms for claims, as well as to determine the patrimonial and non‑patrimonial consequences and effects of the various forms of paternal fraud. In essence, it was concluded that there is a simultaneous violation of the child’s biological, legal, and social identity; moreover, the right to legal certainty is compromised, particularly for the affected parent, and the State’s registral function is undermined.
