| dc.description.abstract | Article 18, subsection 21 of the Notarial Law establishes that public notaries can carry out demarcation and boundary marking actions, by mutual agreement of the parties. However, this authority is limited to rural properties, which implies that in urban areas, these procedures must be carried out through the judicial process. This unjustified restriction hinders the prompt disposal of assets and generates inequality in the exercise of property rights. The objective of this article is to analyze the notary's authority to carry out demarcation and boundary marking, and the implications of limiting this power to rural properties. To fulfill this objective, the inductive method was employed, along with a bibliographic review of specialized legal texts related to the topic. The results showed that demarcation and boundary marking of properties reduce the cost and time that the involved parties must invest in the demarcation and boundary marking process, and also contribute to the efficiency of the justice system. Limiting the notary's action to rural properties prevents the full exercise of property rights and hampers the peaceful resolution of conflicts. In conclusion, restricting the notary's powers exposes these procedures to the risk of delays and unnecessary costs for the owners of urban areas who need to carry out the demarcation and boundary marking of their properties. Therefore, it is necessary to extend the notary's intervention to urban properties, thus promoting the principles of legal certainty and equality in access to justice | |
