Abstract
In this scientific article, a full analysis will be carried out regarding the legal figure of parental authority, within Ecuadorian legislation. Additionally, the factor of family violence and its influence on the rights of children and adolescents will be investigated. Based on this, an effective data collection will be developed, in order to support a possible legal proposal, on the inclusion of a new cause of loss of parental authority, in the inclusion of serious domestic violence, in article 113 of the Code. of Childhood and Adolescence. Contributing to the analysis of ideal ways to guarantee the correct development of boys and girls throughout their growth in Ecuador.

En el presente artículo científico se llevará a cabo un análisis íntegro, respecto a la figura jurídica de la patria potestad, dentro de la legislación ecuatoriana. Adicionalmente, se indaga sobre el factor de la violencia familiar y su influencia en las afectaciones de derechos a los niños, niñas y adolescentes. En base a esto, se desarrollará una recolección de datos eficaz, a fin de respaldar una posible propuesta jurídica, sobre la inclusión de una nueva causa de pérdida de patria potestad, en la inclusión de la violencia intrafamiliar grave, en el artículo 113 del Código de Niñez y Adolescencia.
