| dc.description.abstract | The present research aims to conduct a legal analysis regarding the concept of the non-imputability of juvenile offenders, as well as to examine the regime of civil liability imposed on the parents or legal representatives of these minors in light of the unlawful actions committed by them. A comprehensive study is proposed to determine the nature and scope of the civil liability attributable to the parents of juvenile offenders, in contrast to the principle of non-imputability that protects minors in the criminal sphere. Additionally, a comparative legal analysis is carried out between the legal systems of Colombia and Peru, countries selected due to their status as neighboring states and the similarity of the social and criminological challenges they face in relation to juvenile delinquency. The State, in compliance with its constitutional and conventional obligations, has the primary duty to ensure the comprehensive protection of minors. However, this duty must translate into the implementation of effective public policies and concrete actions aimed at preventing juvenile delinquency. According to studies conducted by specialized social organizations, there has been a significant increase in crime rates associated with juvenile offenders over the past five years. This phenomenon is largely due to the absence of clear and effective state policies aimed at preventing and eradicating the recruitment of minors by criminal organizations for the commission of crimes. 10 Furthermore, this research addresses the legal conflict that arises between the principle of non-imputability of minors and the protection of the rights of victims affected by the unlawful conduct committed by these minors. In this regard, the tensions between guaranteeing the rights of juvenile offenders and the need to compensate the damages caused to affected individuals are analyzed, proposing a balanced approach that reconciles both interests within the framework of the Rule of Law. | |
