| dc.description.abstract | The rights of children and adolescents are recognized by human rights protected under Article 44 of the Constitution (CRE), which mandates the State, society, and the family to prioritize their comprehensive development, ensuring that their rights prevail over those of others under the principle of the best interests of the child. The State must guarantee children's right to be heard, not only before judges acting as protective guardians of their rights, but also fully guarantee their right to education. However, a structural gap exists between this mandate and the education system's capacity to respond to psychosocial risks, due to the saturation of the Student Counseling Department (DECE), which serves up to 450 students per professional, thereby limiting enhanced due diligence. The objective of this research is to analyze the regulatory framework of the DECE and the role of the tutor teacher to substantiate an institutional reengineering that strengthens early detection and timely response. Adopting a qualitative approach, the methods of analysis-synthesis, exegesis, and comparison were applied through a literature review. The results demonstrate that the tutor teacher, due to their daily proximity, possesses a structural advantage as an early warning agent within pedagogical boundaries. It is concluded that a multilevel model integrating tutoring, DECE, and authority materializes the best interests of the child as a procedural rule and optimizes institutional competencies through a tiered risk management path. Keywords: Psychosocial risks, student counseling, homeroom teacher, best interests of the child. | |
