| dc.description | El artículo 389 numeral 7 del Código Orgánico Integral Penal establece dos problemas esenciales: la definición de las condiciones técnico-mecánicas adecuadas en los vehículos y la alta carga de subjetividad del agente de tránsito para establecer que ha ocurrido tal contravención. Por ello, este trabajo persigue como objetivo central establecer la incidencia de la subjetividad de la interpretación de dicho artículo en el derecho a la seguridad jurídica. A través de un enfoque cualitativo y con apoyo del método de análisis-síntesis y la técnica de revisión documental, se estableció la necesidad de reformar la norma indicada para reducir la carga de subjetividad en su interpretación. Se concluye que, tal como se encuentra redactada, vulnera el derecho a la seguridad jurídica y debe considerar también la revisión técnica vehicular como parámetro valorativo y el criterio de culpabilidad consciente del presunto infractor. | |
| dc.description.abstract | Article 389, paragraph 7 of the Comprehensive Organic Criminal Code establishes two essential problems: the definition of the appropriate technical and mechanical conditions for vehicles and the high degree of subjectivity on the part of the traffic officer in determining whether such a violation has occurred. Therefore, this work aims to establish the impact of subjectivity in the interpretation of said article on the right to legal certainty. Through a qualitative approach, supported by the analysis-synthesis method and the documentary review technique, the need to reform the rule to reduce the degree of subjectivity in its interpretation was established. It is concluded that, as currently drafted, it violates the right to legal certainty and should also consider the vehicle technical inspection as an evaluative parameter and the criterion of conscious culpability of the alleged offender. | |
