This research analyzes the 2024 penal reform to Article 220 of the COIP in Ecuador, derived from the Referendum, through the lens of the principle of proportionality and penal guarantees. It examines how the hardening of sentences for drug trafficking and the suppression of technical thresholds via Executive Decree No. 28 have caused a shift from a "Criminal Law of the Act" toward a "Criminal Law of the Author." The study argues that the current criminal policy, influenced by punitive populism, contravenes the constitutional mandate of minimum intervention and the conception of addictions as a public health issue (Art. 364 CRE). By analyzing the proportionality test and the doctrines of authors such as Zaffaroni and Jakobs, the research concludes that the current regulations generate a punitive regression that sacrifices legal certainty and the system's axiological coherence in favor of an ineffective penal symbolism against structural drug trafficking.
