Abstract
Human beings have evolved over time; as science and technology advance,
governments have adapted to the changes demanded by globalization and the
technological age. In this regard, the 2019 health crisis marked a turning point in
the Ecuadorian judicial system, triggering a forced digital transformation that
necessitated a shift from in-person court proceedings to remote hearings, the use
of the E-SATJE 2020 platform, electronic notifications, and other measures;
however, there remains a disconnect with current legislation that has gone
unaddressed.
In light of the foregoing, this research paper will address the analysis of current
legal regulations that guarantee due process, legal certainty, effective judicial
protection, and digital security; examining legal doctrine and case law to
determine the legal implications for civil judicial proceedings. Consequently, the
results reveal gaps in regulation and limitations of remote hearings regarding the
presentation of evidence, which may undermine a judicial ruling and lead to
injustices, financial strain, and state liability.

Los seres humanos han evolucionado con el paso del tiempo, a medida que avanza
la ciencia y la tecnología, los Estados se han enmarcado dentro de los cambios que
la globalización y la era tecnológica demandan. En ese sentido, la crisis sanitaria
del 2019 marcó un antes y un después en el sistema judicial ecuatoriano en torno a
una transformación digital forzada, que obligó a pasar de la presencialidad en los
juzgados a la realización de audiencias telemáticas, el uso de la plataforma ESATJE
2020, notificaciones electrónicas, entre otros; sin embargo, aún subsiste
una desconexión con la legislación actual que ha sido inobservada.
De acuerdo a lo expuesto, el presente trabajo de investigación abordará el análisis
jurídico normativo vigente que garantiza el debido proceso, la seguridad jurídica,
la tutela judicial efectiva y la seguridad digital; examinando la doctrina y
jurisprudencia con el propósito de determinar las implicaciones legales en el
proceso judicial civil. En consecuencia, los resultados evidencian falencias en la
regulación y limitaciones de las audiencias telemáticas respecto a la práctica de la
prueba en detrimento de un fallo judicial pudiendo derivar en injusticias, desgaste
económico y responsabilidad estatal.
