ESTUDIO COMPARATIVO DE LOS TRATADOS INTERNACIONALES Y LA NORMATIVA NACIONAL PARA LA REHABILITACIÓN SOCIAL EN EL ECUADOR

| dc.description | En la presente investigación se realizó una comparación de las leyes y sistemas de rehabilitación social de varios países de América Latina con el objetivo de comparar lo teórico y legal y determinar sí existen políticas efectivas de rehabilitación social en estos países y sí estas difieren significativamente de las leyes y el sistema que implementa Ecuador mediante un análisis documental por el método inductivo con enfoque cualitativo, recogiendo las principales características de la rehabilitación social de diferentes países de América Latina: Ecuador, El Salvador, Argentina, Brasil, Chile, Colombia y Uruguay; y a su vez una recopilación de las teorías y conceptos clave que sirven como base para el análisis y discusión de los resultados. Siendo así que la investigación mostró que las leyes de rehabilitación social para personas privadas de libertad en los países estudiados tienen diferencias significativas en cuanto a los enfoques y estructuras utilizadas para abordar la rehabilitación social de las personas privadas de la libertad. Ecuador tiene un enfoque basado en los derechos humanos, mientras que Argentina y Uruguay promueven la prevención de la criminalidad a través de programas de rehabilitación. Chile y El Salvador buscan mejorar el acceso a la educación y la formación profesional para reducir la reincidencia. Colombia está comprometida con la rehabilitación mediante tratamientos médicos, terapias ocupacionales, entrenamiento vocacional y oportunidades de empleo. Por último, Brasil ha implementado una política para promover la reintegración de los reclusos a la sociedad a través de programas educativos, apoyo laboral y formación. | |
| dc.description.abstract | In this research, a comparison of the laws and systems of social rehabilitation of several countries in Latin America was carried out with the aim of comparing the theoretical and legal aspects and determining if there are effective social rehabilitation policies in these countries and if these differ significantly from the laws and systems of Ecuador through a document analysis using the inductive method with a qualitative approach, collecting the main characteristics of social rehabilitation of different countries in Latin America: Ecuador, El Salvador, Argentina, Brazil, Chile, Colombia and Uruguay; and in turn a compilation of the key theories and concepts that serve as a basis for the analysis and discussion of the results. Therefore, the research showed that the laws of social rehabilitation for people deprived of freedom in the studied countries have significant differences in terms of the approaches and structures used to address the topic. Ecuador has an approach based on human rights, while Argentina and Uruguay promote crime prevention through rehabilitation programs. Chile and the Salvador seek to improve access to education and vocational training to reduce recidivism. Colombia is committed to rehabilitation through medical treatment, occupational therapy, vocational training and job opportunities. Finally, Brazil has implemented a policy to promote the reintegration of prisoners into society through educational programs, job support and training. | |
