Abstract

What matters more in the life of a vulnerable child: the cold rigor of red tape or their fundamental right to a home? This research questions the actual application of the principle of the best interests of the child within adoption processes in Ecuador. Through a qualitative approach and a rigorous analysis of both national and international legal frameworks and jurisprudence, this study exposes a painful reality: the existence of a solid theoretical discourse on comprehensive protection that, in practice, collides with a slow bureaucratic system plagued by legal gaps and unjustified delays. These obstacles condemn hundreds of children to an endless wait, violating their right to grow up in a family in a timely manner. Beyond a mere diagnosis, this paper concludes with an urgent call to action: reform procedural guidelines and genuinely train judicial operators. It is not just about enforcing laws, but about humanizing the procedures so that the child's well-being stops being a theoretical statement and becomes a real, immediate, and barrier-free priority.
