| dc.description | El presente artículo se realiza a través de la metodología documental, exploración de textos, libros que han permitido aclarar conocimientos, establecer ideas y poder formular posibles soluciones ante la falta de normativa existente para la fijación de la caución en el recurso de casación en los procesos civiles establecidos en el Código Orgánico General de Procesos. Una vez recopilada la información necesaria para nuestro trabajo de investigación, se ha llegado a la conclusión que a pesar de que el Pleno del Consejo de la Judicatura tenga como requisito implementar un instructivo para la fijación de la caución desde el año 2015, hasta la presente fecha sigue existiendo ese vacío legal que afecta tanto a la seguridad jurídica, como a la tutela judicial efectiva, por lo que es meritorio, proponer posibles soluciones para que exista un esquema acerca de la fijación de la caución en los procesos civiles, sin dejar al libre albedrío de los juzgadores el tema mencionado en líneas anteriores. | |
