This study analyzes the implementation of States of Exception in Ecuador, considering them as an essential instrument for security policy. It particularly focuses on the declaration of "internal armed conflict", which has been in force since January 2024, as well as its continued application between 2024 and 2026 in Zone 8 (Samborondón, Durán and Guayaquil). The investigation evaluates the real effectiveness of these actions in terms of the fundamental rights that have been harmed. The data show a clear strategic failure: the total number of homicides increased by 27% (from 2,418 to 3,069), common crime remained unchanged and, although 16,096 operations were carried out and 21,318 people were arrested, no medium or large criminal organization was dismantled. Due to the lack of preventive mechanisms, effectiveness indicators and a well-defined system of responsibilities, the exceptional situation has not been able to stabilize and has become normal without establishing sustainable security. With the aim of returning exceptionality to its extraordinary, balanced character and subject to a democratic examination of the results, a reform at the legal level is proposed through the incorporation of a prior, automatic and suspensive constitutional control mechanism into the Organic Law on Jurisdictional Guarantees and Constitutional Control (LOGJCC).
