Abstract

This article analyzes the application of personal detention for non-payment of child support in the Ecuadorian legal system and its impact on the fundamental right to personal liberty. The research stems from the tension between the state's obligation to guarantee the right to child support, in order to protect the best interests of children and adolescents, and the duty to safeguard the fundamental rights of the person obligated to pay support. A qualitative methodology was employed, with a descriptive and analytical scope, based on a study of the Constitution of the Republic of Ecuador, the Code for Children and Adolescents, the General Organic Code of Procedures, international human rights instruments, specialized legal scholarship, and constitutional jurisprudence. The analysis determined that personal detention constitutes a constitutionally legitimate enforcement measure when its application is based on an individualized assessment of the case and passes the proportionality test through the criteria of suitability, necessity, and proportionality in the strict sense. It is concluded that the application of this measure must guarantee an appropriate balance between the protection of the right to child support and respect for the fundamental right to personal liberty.
