| dc.description | La clandestinidad laboral es un problema que afecta a los trabajadores en la actualidad, especialmente a aquellos que prestan sus servicios mediante contratos civiles como el de arrendamiento de servicios inmateriales. Existen ambigüedades y similitudes en la redacción de este contrato y su contraparte laboral que crean un problema de indeterminación de la dependencia, el requisito sine qua non que activa al Derecho Laboral junto con todos los mecanismos de protección para los trabajadores. El objetivo principal de este artículo académico fue demostrar la existencia de esta imprecisión jurídica, al igual que la manera en la que vulnera los derechos laborales mediante la metodología de hermenéutica jurídica junto con un dinámico análisis temático que demuestra tanto la disyunción de ambas esferas del derecho, al igual que sus yuxtaposiciones, corroborando que, evidentemente, la indeterminación existe, y que ello conlleva vulneraciones graves para los derechos constitucionales como los derechos laborales de los trabajadores. | |
| dc.description.abstract | Labor secrecy is a problem affecting workers today, especially those who provide their services through civil contracts such as the intangible service leasing contract. There are ambiguities and similarities in the wording of this contract and its labor counterpart that create a problem of indeterminacy of dependency, the sine qua non requirement that activates Labor Law along with all the protection mechanisms for workers. The main objective of this academic article was to demonstrate the existence of this legal imprecision, as well as the way in which it violates labor rights, using the methodology of legal hermeneutics along with a dynamic thematic analysis that demonstrates both the disjunction of both spheres of law and their juxtapositions, corroborating that, evidently, indeterminacy exists, and that this entails serious violations of constitutional rights as well as the labor rights of workers, contributing to the secrecy and simulations that undermine the current work reality that exists in Ecuador today. | |
