This work seeks to address the evident transition of the Ecuadorian scenario, being of vital importance for the administration of justice and of great notoriety for the academic sphere. Within these lines, establishing the paradigmatic change that converges in the resignation of the judge will also be addressed; imbued with the fact that the law is the armor of the State. The Law is what is needed so that the people can achieve their firmness. And at the end of the day, following the same quote, the Judge, when he scrutinizes the face of the accused at the truth of his life to know what society should make of him, does nothing more than guess. Law refers to the set of theories and rules that are established with the objective that, when implemented, they promote respect for human dignity. It is important to highlight that, to achieve this objective, new theories are constantly proposed and one of these is neo constitutionalism. This approach seeks to establish supremacy of the Constitutional text over other regulations, thus ensuring that respect for the rights and freedoms of the individual predominates. Given the value that this theory has acquired and considering that since 2008 a new constitutional paradigm has been established that establishes dignity and equality as principles of justice, it is decided to write an essay in which initially a contextualization of this theory is carried out and Subsequently, how the right to health is managed based on it is examined.
