LA FIGURA VICEPRESIDENCIAL EN EL ECUADOR Y SU ROL CONSTITUCIONAL EN EL PODER DESDE 1998

Abstract

The vice-presidential figure in Ecuador has been of transcendental importance for the maintenance of democratic stability, its role represents a direct extension of the presidential command, hence its main function is to replace the President of the Republic in his temporary or definitive absence. In this sense, from a qualitative systemic review and a phenomenological examination, an analysis of the vice-presidential role established in the different Constitutions since 1830 was carried out, emphasizing the changes since the 1998 Constitution until the current 2008 Constitution, as well as an analysis of the current facts related to the vice-presidential figure. Methodology: A qualitative systematic review was made of the Constitutions that Ecuador has had, as well as of scientific articles in Spanish and English and books by original authors, on constitutional law, constitutionalism, constitutional reforms, democracy and power published in different databases such as Google Scholar and Dialnet, after the review, 4 books, 16 articles, and 20 Constitutions were selected. It is evident that the figure and role of the vice president has undergone significant changes in the course of time, which have diminished its democratic legitimacy. Conclusion: In Ecuador, from the 1998 Constitution to the current 2008 Constitution, there is ineffectiveness of the figure of the vice president due to its constitutional regulation, reflecting a fragility of democratic representation.
