| dc.description | La presente investigación busca determinar la incompatibilidad entre la responsabilidad penal de las personas jurídicas y la teoría tradicional del delito siguiendo el principio Societas Delinquere Non Potest. El método de investigación aplicado es el analítico, toda vez que se estudió el concepto de persona jurídica, analizando cada uno de sus elementos y su aplicabilidad en el Derecho Penal. Fueron utilizadas técnicas cuantitativas que permitieron dar a conocer la percepción del sector privado con relación al objeto de la investigación. El estudio estuvo basado en el análisis de la doctrina y derecho comparado con respecto a la imputación penal a las personas jurídicas, para posteriormente indagar la manera en que la legislación Ecuatoriana se manifiesta frente a este nuevo paradigma implementado. | es |
| dc.description.abstract | This article pursues to determine the incompatibility between the criminal responsibility of a legal persons and the traditional theory of crime following the principle Societas delinquere non Potest. The research method used is analytical, given that the present study seeks to define the concept of legal persons and their applicability in criminal law, in order to analyze the elements of the definition. Quantitative techniques will be used that will raise awareness of the perception of the private sector in relation to the object of research. The study will be based on the analysis of doctrine and comparative law in relation to criminal charges for legal persons, to further investigate how the Ecuadorian legislation regarding this new paradigm that has been implemented. | es |
