The investigation addresses the issue of improper instrumentation of legal documents and its impact on property registration, focusing on the termination of the community by meeting of quotas, this is a crucial method for ending the state of hereditary community and achieving ownership. The research highlights how errors in the drafting of notarial instruments prevent their proper registration in the “Registro de la Propiedad”, including the inadequate declaration of the termination of the community and the involvement of non-direct successor acquirers. The study analyzes current regulations and practices, reviewing legal frameworks such as the Civil Code and guidelines from registry entities, and identifies the necessary assumptions for the correct application of the termination of the community. The study concludes that improving interoperability between public and private entities, continuous training of professionals, and the adoption of digital technologies are essential to modernize and improve the registration system. By addressing these issues, the research aims to contribute to a more efficient and accurate property registration process.
