| dc.description | Durante este trabajo se analiza el trámite de denuncias de violencia en instituciones educativas de acuerdo con el proceso establecido en la normativa. Adicionalmente, se logra evidenciar como este proceso transgrede los derechos de las víctimas toda vez que se la expone de manera innecesaria ante muchos intervinientes. Con esto, se vulnera su derecho a la intimidad y confidencialidad, así como el poder resolver los casos de manera ágil y eficaz. El método de estudio e investigación usado fue el inductivo utilizando la técnica cualitativa de análisis documentos, sobre la normativa internacional, leyes, y reglamentos locales para el efecto. Finalmente, se propone un cambio a la normativa establecida permitiendo que el Departamento de Consejería Estudiantil pueda de manera inmediata, previa evaluación médica, poner en conocimiento a la autoridad competente para que inicie una investigación ágil e inmediata de lo sucedido sin la necesidad de tener que pasar por un órgano administrativo previo para la resolución de la denuncia de violencia. | |
| dc.description.abstract | This paper analyzes the processing of complaints of violence in educational institutions in accordance with the process established in the regulations. In addition, it is shown how this process violates the rights of the victims, since they are unnecessarily exposed to many intervening parties. This violates their right to privacy and confidentiality, as well as the right to resolve cases in an agile and efficient manner. The study and research method used was inductive, using the qualitative technique based on the analysis of documents related to international norms, laws, and local regulations. Finally, a change to the established regulations is proposed, allowing the Student Counseling Department to immediately, after a medical evaluation, inform the competent authority so that it can initiate an agile and immediate investigation of what happened without the need to go through a previous administrative body for the resolution of the complaint of violence. | |
