Abstract

This study analyzes the enforceability of coercive execution of tax administrative acts which, despite being final and enforceable, are under review through the Recurso de Revisión (Review Remedy), in accordance with Article 143 of the Ecuadorian Tax Code. Employing a qualitative methodology with a legal approach, the research examines the constitutional principles of due process, effective judicial protection, and legal certainty. The central legal issue lies in the contradiction between Article 84 of the Tax Code, which establishes enforceability as a prerequisite for coercive execution, and numeral 5 of Article 320 of the Código Orgánico General de Procesos (General Code of Procedural Law), which allows for the judicial challenge of the resolution issued in the Review Remedy—even though such resolution is based on administrative acts that were paradoxically already considered enforceable. This scenario poses a risk of disproportionate and irreparable harm to the taxpayer. In the absence of a legal provision that suspends execution during the processing of the remedy, this study proposes a legal reform to limit the imposition of precautionary measures within the coercive process. This would ensure a reasonable balance between the State’s fiscal enforcement powers and the effective protection of taxpayers’ constitutional rights, without undermining the exceptional and corrective nature of the Review Remedy.
