Abstract

This academic article examines a crucial deficiency in the Ecuadorian criminal system: the absence of an effective procedural sanction when the Prosecutor's Office breaches the deadlines of prior investigation. Although the Organic Integral Criminal Code (hereinafter COIP) establishes temporary limits, its non -observance only entails a lower disciplinary sanction for the prosecutor, leaving the investigated in a state of prolonged defenselessness. This legal omission creates a "legal limbo" that violates the presumption of innocence and due process, although the Constitutional Court has ratified the regulations regarding previous investigation and its archive, it does not guarantee the exercise of substantive justice, reducing the process to a mere bureaucratic formalism. From an analysis compared to the criminal systems of Bolivia and Peru where the parties are allowed to request judicial control on the deadlines, the study concludes that the Ecuadorian model is less guarantee. Therefore, a reform of article 586 of the COIP, is proposed to establish judicial terms control guaranteeing that the process is agile and protects the rights of victims and those investigated.
